A:  California's compulsory financial responsibility law requires all drivers to have automobile insurance.  California follows a tort system, which means that the person who is at fault for causing the accident is responsible for paying the injured person's medical bills and property damage. Therefore, depending on the circumstances, you may be able to recover for your medical expenses and San Diego personal injuries from the driver who is at fault if he or she is insured or has assets to cover your expenses.

Drivers should also be aware that in California, Vehicle Code Section 16056 requires that drivers have the following minimum amounts of liability insurance coverage:

  • $15,000 for bodily injury or death of one person for one accident
  • $30,000 for bodily injury or death of two or more persons for one accident
  • $5,000 for property damage for one accident
