California Consumers Legal Remedies
California's Consumers Legal Remedies Act (CLRA), starting at California Civil Code Section 1750, protects consumers against unfair and deceptive business practices in transactions involving the sale or lease of goods or services. CLRA defines "services" to include work, labor and services that are not for a commercial or business use.
The CLRA prohibits several unfair or deceptive acts against consumers under CLRA Section 1770(a), such as the following:
- Misrepresenting the source or certification of goods or services
- Representing that goods are original or new even though they have deteriorated or are secondhand
- Representing that a transaction confers rights or remedies that actually do not exist or are prohibited by law
Consumers bringing an action under the CLRA may be able to recover actual damages, which are the actual losses the individual incurs, and consumers may request the court to stop the offending party from engaging in the prohibited act.
Auto Fraud
Purchasing a vehicle involves a significant amount of research and finances. Unfortunately, however, even if buyers make their best efforts to purchase a good vehicle there are auto dealers who engage in deceptive, unlawful practices. These practices include:
- Selling or reselling a vehicle without disclosing that the vehicle was damaged or rebuilt
- Selling a car with salvage title without disclosing this information
- Packing loans or lease agreements with unfair terms or very high interest rates
- Altering or failing to disclose the vehicle's true accident or maintenance record, history, mileage, or condition
