  • The product has a manufacturing defect:  If the product has a manufacturing defect then mistakes were made during the production stage of the manufacturing process.  When this occurs, most of the products coming off the assembly line may be safe to use, but one or more of the products may be defective.  This type of defect is typically the easiest to notice because other identical products are not defective.  Many things can cause a manufacturing defect, such as the use of substandard materials, the manufacturer's failure to check the quality of the finished product, or faulty equipment on the manufacturing line. 
  • The product has a design defect:  If products are poorly or ineffectively designed, then every product that is manufactured with that design will be defective.  
  • The product fails to warn of potential dangers:  In general, products must have adequate labels to warn consumers of any dangers associated with the use of the product. The warnings must be clear, visible, and legible. Even if a product is safe in its design and manufacture, if the warnings and instructions are vague, incomplete, or fail to disclose a known risk associated with a product, the manufacturer can be held liable for any resulting damages.  Even if the danger was discovered after the product went on the market, the manufacturer can sometimes also be held liable for failing to take steps to correct or add proper warnings.
